1. Acceptance of terms
By accessing this website, creating an account, or placing an order, you agree to these Terms of Service, our Research Use Disclaimer, and our Privacy Policy. If you do not agree, do not use this website.
2. Account creation and age gating
You must be at least 21 years old to create an account or place an order. You are responsible for keeping your account credentials confidential and for all activity on your account. Notify us immediately at support@elev8labsrx.com if you suspect unauthorized access.
We may suspend or terminate an account at our discretion if we observe fraud, misrepresentation, diversion to consumer use, chargeback abuse, or violation of these Terms.
3. Acceptable use
You agree not to:
- Purchase or resell our products for human or veterinary consumption.
- Attempt to reverse-engineer, scrape at scale, or disrupt the website or its infrastructure.
- Use another person's payment credentials or identity.
- Circumvent the age-verification gate or any other access control.
- Misrepresent your research purpose or institutional affiliation.
Violation of this section may result in order cancellation, account suspension, and referral to law enforcement where appropriate.
4. Orders, pricing, and product availability
All orders are offers to purchase, subject to our acceptance. We reserve the right to refuse, cancel, or limit orders for any reason, including suspected misuse, pricing error, or inventory shortfall.
- Prices are listed in U.S. dollars and exclude shipping and applicable sales tax.
- Product descriptions and analytical values reflect the most recent certificate of analysis (COA) for that lot. Values may vary slightly between lots within stated tolerances.
- We reserve the right to correct typographical errors in pricing or product data before an order ships.
5. Payment terms
Payment is processed at checkout through a third-party payment gateway. Our servers do not receive or store full card numbers or CVV values; card data is tokenized in your browser before transmission. We store only tokens, last-four digits, and expiration month/year for order administration.
- We accept credit and debit cards through our payment gateway.
- We also support manual payment methods including Zelle and Cash App. Orders placed with a manual payment method remain in a
pending_paymentstatus until a member of our team confirms receipt; this review is not automated. - Duplicate charge attempts within a 24-hour window are deduplicated by our idempotency layer; you will not be double-charged when a network retry occurs.
- Failed authorizations are surfaced with a safe, actionable message. Raw gateway errors are never displayed.
6. Product descriptions and accuracy
We make a good-faith effort to describe each product accurately, including purity, analytical method, and reference standard identity. COA values reflect the assay for the specific lot shipped. Actual analytical values may vary within the tolerances stated on the COA.
Product photography on this site depicts representative packaging and is not a contract for cosmetic specifics (label fonts, fill lines, etc.).
7. Shipping and delivery
See our Shipping Policy for handling windows, carriers, restrictions, and lost-package procedures. Title and risk of loss pass to you upon carrier pickup.
8. Refunds and returns
See our Refund Policy for the full policy. All sales are final — we do not issue refunds, store credits, or exchanges for change of mind or unused inventory. The only exceptions are documented product issues (fulfillment error, damage in transit, missing documentation, or analytical failure) reported within the windows stated in the Refund Policy.
9. Subscriptions
Subscription orders renew automatically at the cadence you select. Plan changes apply to the next billing cycle; we do not prorate mid-cycle changes. You may pause, resume, or cancel a subscription at any time from your account dashboard. A failed renewal attempt is retried on a fixed schedule; after the retries are exhausted, the subscription pauses and you are notified by email.
10. Intellectual property
The elev8 Labs name, logo, site copy, photography, and analytical presentation format are our property or used under license. You may not reproduce, distribute, or create derivative works from this content without written permission. Your right to use the website is a limited, revocable, non-transferable license for lawful research purchase activity only.
11. Feedback
If you send us feedback or suggestions about our products or website, you grant us a non-exclusive, royalty-free, perpetual license to use that feedback to improve our offerings, without obligation to compensate you.
12. Disclaimers
The website and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted or error-free, or that any specific research outcome will result from use of our products.
13. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising from or related to these Terms, the website, or any product purchase is limited to the amount you paid for the specific order that gave rise to the claim.
We are not liable for indirect, consequential, incidental, special, exemplary, or punitive damages, or for lost profits, lost research data, or lost goodwill, even if we were advised of the possibility of those damages.
14. Indemnification
You agree to indemnify and hold harmless elev8 Labs, its officers, employees, and affiliates from any claim, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of any product, or your violation of any applicable law.
15. Governing law and venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.
Any dispute arising from or related to these Terms is subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware. You and elev8 Labs each consent to personal jurisdiction in those courts. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property, trade secrets, or confidential information.
16. Modifications
We may modify these Terms from time to time. Material changes will be noted by updating the "last updated" date at the top of this page and, where practicable, by notifying registered account holders via email. Continued use of the website after an update constitutes acceptance of the revised Terms.
17. Severability
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
18. Entire agreement
These Terms, together with the Research Use Disclaimer, Privacy Policy, Refund Policy, Shipping Policy, and — for wholesale partners — the Wholesale Agreement, constitute the entire agreement between you and elev8 Labs regarding your use of this website.
